1. Acceptance of Terms

Welcome to Flowcus! These Terms of Service ("Terms") govern your access to and use of the Flowcus web application (the "App"), the website located at Flowcus.work (the "Website"), and any related services, features, content, or applications offered by Church of Scovillism ("we," "us," or "our") (collectively, the "Service").

By accessing or using the Service, creating an account, initiating a trial, subscribing, or clicking a button or checking a box marked "I Agree" (or similar), you signify that you have read, understood, and agree to be bound by these Terms and our accompanying Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms or the Privacy Policy, you may not access or use the Service.

PLEASE READ THESE TERMS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS, INCLUDING VARIOUS LIMITATIONS AND EXCLUSIONS, AND A CLAUSE THAT GOVERNS THE JURISDICTION AND VENUE OF DISPUTES.

2. Description of Service

Flowcus provides a productivity and task management platform designed to help users organize tasks, manage focus, and enhance efficiency. Features include, but are not limited to, task creation and management, AI-powered task breakdown suggestions, audio encouragement prompts, a Pomodoro timer, focus modes, an accountability ("Buddy Up") system involving video calls, gamification elements (XP, streaks, achievements), and offline access capabilities with background synchronization.

We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice to you, and we will not be liable to you or to any third party should we exercise such rights. Modifications may include changes to features, functionality, or pricing (subject to the notice requirements in these Terms).

3. Eligibility and Account Registration

Eligibility

You must be at least 16 years of age (or the age of legal majority in your jurisdiction) to use the Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement.

Account Creation

To access the Service, you must register for an account. You may register using an email and password, or through third-party authentication providers like Google, GitHub, or Apple.

Accurate Information

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your password and any other credentials used to access your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You are solely responsible for any activities or actions that occur under your account, whether or not you have authorized such activities or actions.

4. Subscription, Free Trial, and Payment

Free Trial

We may offer a one-time free trial period for new users (e.g., 14 days). The duration and specific terms of the free trial will be specified at the time of sign-up. At the end of the free trial period, if you have not canceled, you may be automatically enrolled into a paid subscription, and your payment method may be charged, unless otherwise stated during the sign-up process. You may cancel your free trial at any time before it ends through your account settings.

Subscription

Access to the Service after the free trial period (or if no trial is offered) requires an active paid subscription. The current subscription fee is $4.99 USD per month, payable in advance. We reserve the right to change subscription fees, but we will provide you with advance notice (e.g., 30 days) of any fee changes.

Billing Cycle

Subscriptions are billed on a monthly basis on the calendar day corresponding to the commencement of your paid subscription.

Payment Processing

We use RevenueCat as a third-party service provider to manage subscriptions and process payments. By subscribing, you agree to RevenueCat's terms and privacy policy in addition to ours. You must provide RevenueCat with valid and current payment information. You authorize RevenueCat (acting on our behalf) to charge your payment method for the subscription fees.

Cancellation

You can cancel your subscription at any time through your account settings page within the App or Website, or potentially through the platform where you initiated the subscription (if applicable, e.g., through an app store managed by RevenueCat). Cancellation will be effective at the end of your current billing cycle. You will retain access to the paid features until the end of the billing cycle. No refunds or credits will be provided for partial subscription periods.

Failed Payments

If a payment is not successfully settled due to expiration, insufficient funds, or otherwise, we may suspend your access to the paid features of the Service until we have successfully charged a valid payment method.

5. User Conduct and Responsibilities

You agree not to misuse the Service or help anyone else do so. You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Violating or encouraging others to violate the rights of third parties, including intellectual property rights.
  • Posting, uploading, or distributing any content that is unlawful, defamatory, libelous, inaccurate, or otherwise objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or inappropriate.
  • Interfering with security-related features or the operation of the Service.
  • Uploading or disseminating viruses, malware, or other malicious code.
  • Making unsolicited offers or advertisements.
  • Attempting to collect personal information about others without consent.
  • Accessing or copying Service content through automated means without permission.
  • Engaging in fraudulent activity or impersonation.
  • Reverse engineering or attempting to discover the source code (except where permitted by law).
  • Using AI features to generate illegal, harmful, or infringing content. You acknowledge AI suggestions may be inaccurate and require validation.
  • Engaging in disrespectful, harassing, or abusive conduct during Buddy Up sessions. Unauthorized recording of sessions is prohibited. Interactions with other users are at your own risk.
  • Manipulating or exploiting the gamification system.

We reserve the right to investigate and take appropriate action, including account suspension or termination, against anyone who violates these rules.

6. User Content

Ownership

You retain ownership of your User Content (tasks, steps, notes, etc.).

License

You grant Church of Scovillism a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and distribute your User Content solely to operate, provide, and improve the Service, consistent with our Privacy Policy.

Responsibility

You are solely responsible for your User Content and warrant that you have the necessary rights to grant the above license and that your content is lawful.

Backup

You are responsible for backing up your User Content. We are not liable for any loss or corruption.

7. Our Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are the exclusive property of Church of Scovillism and its licensors, protected by copyright, trademark, and other laws. Our trademarks may not be used without prior written consent. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service according to these Terms.

8. Third-Party Services and Links

The Service integrates with third-party services (Firebase, Google Sign-In, GitHub Sign-In, Apple Sign-In, OpenRouter/Google AI APIs via proxy, Cloudflare Calls via proxy, RevenueCat). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Termination

By You

You may terminate your account and subscription at any time by navigating to your user settings page within the App or Website and clicking the "Delete Account Permanently" button. Please note that terminating your account will result in the deletion of your User Content (subject to our data retention policy) and cancellation of your subscription at the end of the current billing cycle (no refunds for partial periods).

By Us

We may suspend or terminate your access to the Service (including your trial or subscription) at any time, with or without cause or notice, particularly for breaches of these Terms, legal requests, service discontinuation, technical issues, or extended inactivity.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Subscription fees are non-refundable except as required by law. We may delete your account and User Content. Sections related to intellectual property, disclaimers, limitations of liability, indemnification, and governing law shall survive termination.

10. Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. CHURCH OF SCOVILLISM DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF AI-GENERATED CONTENT OR ANY SPECIFIC PRODUCTIVITY OUTCOMES. YOUR USE OF THE BUDDY UP FEATURE AND INTERACTIONS WITH OTHER USERS ARE AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHURCH OF SCOVILLISM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE, THIRD-PARTY CONDUCT OR CONTENT, CONTENT OBTAINED FROM THE SERVICE, OR UNAUTHORIZED ACCESS TO YOUR CONTENT. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE TOTAL SUBSCRIPTION FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Church of Scovillism, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

You agree to resolve any disputes arising out of or relating to these Terms or the Service through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent unauthorized use or abuse of the Service or intellectual property infringement. Arbitration shall take place in Cheyenne, Wyoming, or allow remote.

YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide at least 30 days' notice (e.g., by posting on the Website, in-app notification, or email) before the changes take effect. By continuing to use the Service after revisions become effective, you agree to the revised terms. If you do not agree, you must stop using the Service and cancel your subscription.

15. Miscellaneous

  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision is held invalid or unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any right or provision is not a waiver of such right or provision.
  • Assignment: You may not assign these Terms, but we may assign them without restriction.
